TERMS & CONDITIONS

1. COPYRIGHT

a. The copyright Designs and Patents Acts assign the copyright of the images to Morgan Shoots Media.

2. MARKETING & ADVERTISING

a. The client(s) hereby allow(s) the photographer to use any footage covered by this contract to generally promote the business in advertising and for marketing purposes at their discretion.

3. CREATIVE LICENSE

a. Photographs/Videos taken during the course of the project will be at the discretion of the photographer although every effort will be made to comply with the clients requirements.

b. The Photographer(s) will do their best to honour the special requests of the client but cannot guarantee any specific picture(s) or the incorporation of any specific background, location or group arrangements due to changes in weather and the availability and willingness of subjects.

c. For a booking involving certain venues, where the photographer's movements are sometimes restricted by the official in charge. the photographer cannot accept responsibility for any obstructed views should this be the case.

d. Due to a variety of lighting conditions and the limitations of digital sensors, some colours

may alter through the duration of a set of photographs.

e. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for footage damaged due to technical failure.

4. PAYMENT

a. A non-refundable deposit of 50% will confirm your booking, as well as full acceptance of the terms and conditions as stated. The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance due.

b. Payment in full of the remaining balance will be paid on completion of the project.

c. Additional goods ordered must be paid for in full at the time of ordering.

d. Titles to all footage remains with Morgan Shoots Media until paid for in full by client(s). All invoices must be paid within 7 days of receipt.

 

5. CANCELLATION

a. If the client(s) should have to cancel a booking from the booking date and up to two weeks before the project start date, they will be responsible for paying the non-refundable 50% deposit.

b. If the client(s) should have to cancel a booking once the project has already started the client(s) will have to pay the fees for any work which has already been completed alongside the non-refundable 50% deposit. The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.

c. In the very unlikely event of cancellation by the photographer or of total photographic

failure, Morgan Shoots Photography will issue the client(s) a full refund of any fees paid.

d. If possible the photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. weather conditions, sudden illness/injury, victim of crime, traffic conditions, vehicle breakdown etc.

6. TRAVEL & INSURANCE

a. Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.

b. Insurance costs are not included in the overall package prices. Morgan Shoots Media will notify the customer of any additional incurred costs at the time of the first invoice.

c. Travel within a 30 mile radius of the Morgan Shoots Media headquarters is covered in the package prices, anything outside of this will be an additional charge of 50p per mile.

 

7. DELIVERY

a. The photographer will endeavour to deliver digital files as quickly as possible. However this may take up to 4-6 weeks during busy periods.

b. All digital files will be delivered to the client(s) via web link unless otherwise agreed with Morgan Shoots Media .

c. Frames may vary in design as all are subject to availability. Morgan Shoots Media will endeavour to deliver the stated package to the best of their ability.

 

8. MISCELLANEOUS

a. Any of the stated packages & prices are subject to change without notice. Morgan Shoots Media will notify the client(s) of any changes to agreed prices prior to invoicing.

These terms & conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by Morgan Shoots Media in writing.
